DMCA Policy
Project Glasswing is committed to respecting the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website, Project Glasswing will respond promptly to claims of copyright infringement reported through our designated agent.
This policy outlines the procedures for copyright owners to report alleged infringements and for users to submit counter-notifications if they believe their content was removed in error.
Filing a DMCA Notice of Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on Project Glasswing infringes upon your copyrights, you may submit a written notification pursuant to the DMCA by providing our Copyright Agent with the following information:
- Identification of the copyrighted work claimed to have been infringed: This includes a description of the work and, if possible, a URL or other location where an authorized version of the work may be found (e.g., an ISBN for a book, or a link to its original publication).
- Identification of the material that is claimed to be infringing: Provide sufficient detail to allow Project Glasswing to locate the material on our site. This typically includes the URL(s) where the infringing material is located.
- Contact information of the complaining party: Your full legal name, mailing address, telephone number, and email address.
- A statement that the complaining party has a good faith belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate: And, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature: Of the complaining party or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Filing a DMCA Counter-Notification
If you believe that material you posted on Project Glasswing was removed or disabled as a result of mistake or misidentification, you have the right to submit a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA. A counter-notification must be a written communication provided to our Copyright Agent and include substantially the following:
- Identification of the material that has been removed or to which access has been disabled: And the location at which the material appeared before it was removed or access to it was disabled.
- Your contact information: Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court: For the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Project Glasswing may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- A statement under penalty of perjury: That you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your physical or electronic signature.
